THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN `B' GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE E.S.INDIRESH - 3 - HC-KAR CNR: KAHC010165922018 NC: 2026:KHC:42766 WP No. 46173 of 2018 ORAL ORDER In this writ petition, the petitioner is assailing the order dated 16.07.2012 (Annexure-E) passed by respondent No.3 and order dated 04.09.2018 (Annexure- J) passed by respondent No.1 inter alia, sought for a direction to the respondent No.3 to enter the name of the petitioner in the revenue records in respect of the subject land. 2. Having heard the learned counsel for the parties and on careful consideration of the impugned order at Annexure-J dated 04.09.2018 would indicate that, the name of the private respondents herein has been entered in the revenue records as per the registered sale deed dated 20.08.1901 and 14.02.1907. On the contrary, the petitioner is claiming right over the property based on the registered gift deed dated 03.11.1917 made in favour of the mother of the petitioner. - 4 - HC-KAR CNR: KAHC010165922018 NC: 2026:KHC:42766 WP No. 46173 of 2018 3. In that view of the matter, in the event, if the mother of the petitioner has gifted the schedule property during 1917, however, no material has been produced by the petitioner as to change of katha since 1917. 4. In that view of the matter, I am of the view that, no interference is called for in this petition as the change of katha in favour of private respondents is made based on the registered sale deeds. Accordingly, writ petition is rejected. SD/- (E.S.INDIRESH) JUDGE BKM List No.: 1 Sl No.: 43
