THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: ORAL ORDER Sri.Prabhu Yadlapur, petitioner / party-in-person and Sri.Rajakumar M., Additional Government Advocate for respondents appeared in person. 2. This petition is filed seeking following reliefs: (a) Issue a writ of mandamus or any other appropriate writ, order or direction under Article 226 of the Constitution of India directing all the respondents to jointly, severally or in appropriate proportions pay a lump sum financial compensation of Rs.30,40,000/- (Rupees Thirty Lakh Forty Thousand only) to the petitioner towards the direct, cumulative financial loss and complete deprivation of livelihood caused by the egregious combined 8 + year institutional delay and systematic violation of mandatory statutory timelines under the Industrial Disputes Act, 1947, - 3 - HC-KAR CNR: KAHC010486652026 NC: 2026:KHC:44232 WP No. 22173 of 2026 in relation to Reference No.28/2022 (Annexure- C). (b) Direct all respondents to jointly and severally pay exemplary damages and tortuous compensation of Rs.10,00,000/- (Rupees Ten Lakh Only) to the petitioner for the intense psychological trauma, acute institutional neglect and administrative harassment suffered by the petitioner due to the collective failure of the state and judicial administrative machinery to adjudicate the dispute for nearly a decade. (c) Pass such other orders or reliefs as this Hon'ble Court deems fit just and proper under the facts and circumstances of the case, in the interest of equity, institutional accountability and substantial justice. 3. Party in person submits that the relief sought in the writ petition may be granted. 4. Heard the arguments and perused the papers with care. 5. The prayer indicates that the petitioner is requesting Rs.30,40,000/- plus Rs.10,00,000/- in compensation under writ jurisdiction. Pursuing claims for - 4 - HC-KAR CNR: KAHC010486652026 NC: 2026:KHC:44232 WP No. 22173 of 2026 compensation requires a detailed examination of disputed facts and evidence, which cannot be effectively addressed through a writ petition under Article 226 of the Indian Constitution. 6. Accordingly, the writ petition is dismissed. Because of the dismissal of the Writ Petition, any interim order stands discharged, and pending interlocutory applications, if any, are disposed of.
