CRM-M-42205 of 2026(O&M) 2 petitioner was summoned to face trial under Section 138 of Negotiable Instruments Act, 1881 vide order dated 13.12.2023. Numerous times, summons were issued to procure his presence but could not be executed on account of incorrect address. On 23.05.2025, learned Sub Divisional Judicial Magistrate, Sri Anandpur Sahib directed issuance of bailable warrants in the sum of Rs.5000/- with one surety in the like amount which could not be executed for which reason, on 17.07.2026, the Court issued non-bailable warrants against him, for 21.09.2026. The offence under Section 138 of Negotiable Instruments Act, 1881 is bailable and non-bailable warrants have been issued only to procure presence of the petitioner, when it appeared to the Court that petitioner was intentionally not putting in appearance and was only watching the proceedings from outside. As such, there is no illegality in the order dated 17.07.2026 nor any ground made out to quash the order. However, since the petitioner has expressed his intention to surrender in the Court and face trial, he is directed to put in appearance before the Court on the date fixed i.e. 21.09.2026.Till then the non-bailable warrants be kept in abeyance.
4. This order is being passed without notice to respondent considering the nature of the offence and proceedings before learned Sub Divisional Judicial Magistrate, Sri Anandpur Sahib.
5. The petition stands disposed of. All the pending miscellaneous applications, if any, stand disposed of.
