D/L281 17.08.2026 Bpg. C.R.M. (A) 1871 of 2026 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Basirhat Police Station Case No.1089 of 2025 dated 14.11.2025 under Sections 21(C) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985; Sabbir @ Chhabir Ali Molla Versus The State of West Bengal Mr. Kishore Mukherjee. …for the petitioner. Mr. Shataroop Purkayastha. …for the State. Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of the statement of co-accused. There has been no recovery from the present petitioner, as such, petitioner may be granted the relief as prayed for. Learned advocate for the State submits that the petitioner fled away from the spot from where recovery has been effected in respect of 50 bottles of Wincerex Cough Syrup. Report submitted by the police authorities reflects that there are four criminal cases against the petitioner which incorporates amongst others cases under the Arms Act. 2 Having considered the antecedents of the petitioner, I am of the opinion that this is not a fit case for granting anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner in CRM(A)1871 of 2026 is dismissed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
