Though the writ petition contains several prayers made by the petitioner, learned counsel for the petitioner submits that the only prayer of the petitioner is grant of subsistence allowance in his favour. It appears from the report submitted by the State that the petitioner has admitted before the Block Development Officer by a letter written on July 10, 2026 that he has used abusive language towards the authority and has not attended office in the last three years. This Court is informed that a departmental proceeding is pending against him. He seeks transfer to Madhupur Gram Panchayat. Several opportunities of hearing were granted to the petitioner by the authority and several notices issued upon him to which he did not care to respond. Though learned counsel for the petitioner submits that the petitioner and his son are suffering from various ailments, there is no contemporaneous document to substantiate the same. In view of the conduct of the petitioner as appears from the record, this Court is inclined to hold that since the petitioner seeks subsistence allowance, he is at liberty to submit an application seeking the same before the concerned authority within two weeks from date. The Block Development Officer, Domkol Development Block, being the 7th respondent herein, is directed to consider and dispose of the same within four weeks from the date of receipt thereof upon granting reasonable opportunity of hearing to the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
