“ 10.1 That, the Hon’ble Court may be pleased to issue an appropriate writ in the nature of mandamus or certiorari and quash /set aside the the impugned advertisement dated 08.12.2020 (Annexure P/1) issued by respondent No.2. 10.2 That, the Hon’ble Court may be pleased to issue the appropriate direction to the respondent authority for allotment of the government fair price shop to the petitioner society as per recommendation dated

10.3. Any other relief/reliefs which this Hon’ble Court may think fit and proper in the facts and circumstances of the case, with the cost of the petition, may also please be granted to the petitioner.”
2. Learned counsel appearing for the petitioner submits that the petitioner is aggrieved by the re-advertisement dated 08.12.2020 issued by respondent no. 2, pursuant to the instructions of respondent no. 1, for allotment of the Government Fair Price Shop. It is submitted that, pursuant to the earlier advertisement dated 29.08.2020, the competent authority had already made a recommendation for allotment of the said shop, wherein the name
3 of the petitioner finds place. The subsequent re-advertisement, despite the aforesaid recommendation, is alleged to be arbitrary, discriminatory and indicative of bias on the part of the respondents. Learned counsel, however, confines the relief sought in the present petition to a limited extent and seeks liberty to the petitioner to avail the appropriate statutory remedy by preferring an appeal before the State Government against the impugned action of the respondents. It is, therefore, prayed that the petitioner may be granted liberty to prefer an appeal before the competent authority/State Government within a stipulated period and till the said appeal is filed and considered by the competent authority, the interim order/stay granted by this Court vide order dated 09.02.2021 may kindly be continued,
3. Learned counsel for the State submits that he has no objection if the petitioner is permitted to file an appeal before the State Government.
4. Having heard learned counsel for the parties, upon due
consideration of the facts and circumstances of the case, as well as the submissions advanced on behalf of the petitioner, the petitioner is directed to prefer an appropriate appeal before the State Government within a period of 15 days from today. The State Government, in turn, is directed to consider and decide the said appeal, in accordance with law, after affording due opportunity of hearing to the petitioner, within a further period of 45 days
4 from the date of receipt of the appeal. The interim order dated 09.02.2021 passed by this Court, whereby the respondents were restrained from taking any final decision in respect of the Fair Price Shop of Wards Nos. 14 and 15, shall remain operative till the appeal is decided by the State Government.
5. With this observation and direction, this petition stands disposed of.
