It is the apprehension of the petitioner/plaintiff that the observations made in the impugned judgment that the transaction is benami transaction and this observation may come for considering the application filed by the defendant under Order VII Rule 11 of Code of Civil Procedure. Therefore, prayed to clarify the said observation. 3. Learned counsel for the respondent/defendant submitted that this Court has specifically ordered and observed that the order of this Court shall not influence the Trial Court while considering the case on merits. Therefore, it is submitted that there is no necessity of passing once again that the order shall not influence the trial Court while deciding the case on merits. - 6 - HC-KAR CNR: KAHC010845922025 NC: 2026:KHC:39547 RP No. 602 of 2025 4. It is observed in the order with regard to nature of transaction, but not with regard to application or non-application of law. However, it is clarified that, whatever observations made in the order shall not influence the trial Court while considering application, if any, filed under Order VII Rule 11 of CPC. If the said application is filed, the trial Court shall consider the same on its own merits and also the grounds urged by the defendant regarding transaction shall be considered independently. 5.
