This is an application for appointment of arbitrator under section 11 of the Arbitration and Conciliation Act, 1996 filed by the petitioner. 2. In view of the disputes and differences that have arisen in connection with a contract for “extension of New Dry Dock-II at Marine dock yard including supply, installation and commissioning of dry dock pumps and accessories in Port Blair, South Andaman”. The agreement dated 17th March, 2017. 3. There is an arbitration clause 3.26.2 in the contract. It is submitted that there is no agreement between the parties with regard to the disputes being settled to the Dispute Redressel Committee (DRC). Any event there is no report of any decision or proceeding through the DRC produce by the respondents till date. 4. This Court therefore appoints Sri T.S. Sivagnanam, (9445373838) a Former Chief Justice of the High Court at 2 Calcutta as a Sole Arbitrator to enter upon the reference and decide the claims and counter claims filed by the parties. 5. The arbitration shall be conducted in terms of the Act of 1996 and the Rules framed thereunder. The fees of the arbitrator shall be governed by the Act of 1996 and the said Rules. 6. With the aforesaid observation, AP/2/2026 stands disposed of. 7. The parties shall communicate a copy of this order to the learned Arbitrator. 8.
