Hon’ble Siddhartha Sah, J. Mr. Sandeep Kothari, learned counsel for petitioner. 2. Mr. Yogesh Chandra Tiwari, learned Standing Counsel for the State. 3. The Excise Commissioner invited bids from interested persons for grant of license for Indian Made Foreign Liquor Shops at Didihat, Pithoragarh. 4. According to petitioner, he submitted an offer of `4.84 crores through his representative Anand Jung. However, instead of accepting his bid, the Competent Authority accepted bid submitted by another person for `2.62 crores. 5. Learned State counsel, however, disputes the said submission. He submits that the authorized representative of petitioner withdrew the offer submitted on behalf of petitioner before its acceptance by Competent Authority. 6. Learned counsel for petitioner, however, disputes the said submission and he contends that the representative of petitioner had to withdraw the offer under duress. 7. The issue raised by petitioner cannot be 2026:UHC:2841-DB decided without going into disputed questions of facts; therefore, this Court is not inclined to entertain the writ petition at this stage. We, accordingly, dispose of the present writ petition by permitting petitioner to make representation to Secretary, Department of Excise within three days from today. If petitioner makes representation within stipulated time, the Secretary, Department of Excise shall look into the issue as raised by the petitioner and shall take appropriate decision, as per law within three weeks thereafter. 8. It goes without saying that other bidders including successful bidders shall also be heard by the Secretary, Department of Excise before passing any order. (Siddhartha Sah, J.)
