1. On 3rd June, 2026, a co-ordinate Bench of this Court passed the following
order:-
“The Court: In the instant case, the petitioner challenges, inter alia, the inaction on the part of the respondent authorities in failing to execute and register the deed of lease between the petitioner and the Kolkata Municipal Corporation, despite the same having been approved in August, 2025. The petitioner alleges that the respondent authorities have not taken the necessary steps for completion of the registration of the deed of lease measuring about 2.75 cottahs situated at premises no. 97A, S.P. Mukherjee Road, Kolkata – 700026, Kalighat Park, P.S. – Tollygunge.
Learned Counsel appearing on behalf of the KMC authorities submits that, owing to a change of incumbent, the process relating to the execution and registration of the lease deed could not be completed. The erstwhile Municipal Secretary vide letter dated 6th March, 2026 made an application for exemption for personal appearance during the course of registration and to allow
2 registration through commission but the same remain pending for
consideration. Having heard the parties and upon perusal of the available records, I am satisfied that the petitioner has made out a prima facie case and that an interference is warranted in this case. In the interest of justice and considering the issue concerning registration pending of the lease deed has remained pending for a considerable period of time, I direct the respondent no. 2 to forthwith execute the registration of the lease deed by appearing personally before the registering authority within a period of 6 weeks from the date of communication of this order, failing which appropriate orders shall be passed in accordance with law. Let the matter appear on 22nd July, 2026. The respondent authorities are
directed to file a compliance report on the next date of hearing in this regard.”
2. Today the learned Advocate for the petitioner by placing before this Court the copy of the deed of lease dated 9th July, 2026 would submit that the respondent has already executed the lease deed and grievance of the petitioner has been made. Accordingly, by retaining the copy of the lease deed, the writ petition stands disposed of without any further order.
