ORAL ORDER The petitioner and the respondent along with their respective counsel are present.
2. The petitioner and the respondent have filed a joint memo stating that the parties have amicably settled the dispute. In terms of the settlement, the petitioner has agreed to pay an amount of Rs.2,85,000/- towards full and final settlement to complainant/respondent and respondent also agreed for the same. It is further submitted that the petitioner has deposited a sum of Rs.44,500/- on 06.01.2025 and Rs.1,78,000/- on 01.06.2026 before the Trial Court and the petitioner has no objection to withdraw the said amount by the respondent. The balance amount of Rs.62,500/- also paid on 30.07.2026 to the respondent/complainant and respondent also acknowledged the same. Hence, prayed to dispose of the matter in terms of the joint memo.

3. In view of the settlement arrived between the parties, the petitioner is acquitted for the offence punishable under Section 138 of N.I. Act. Accordingly, the petition is
disposed of in terms of the joint memo.
4. The respondent/complainant is permitted to withdraw the amount in deposit before the Trial Court on production of proper identification.
5. The petitioner is directed to pay the fine amount of Rs.5,000/- as ordered by the Trial Court within two weeks from today and produce the receipt for having paid the said fine amount before the registry within a week thereafter.
6. If petitioner fails to deposit the said fine amount, list the matter before the Court on 20.08.2026.
