Order on Board 07.09.2026
1. This petition has been filed under Article 226 of the Constitution of India with following reliefs:
2
“10. Relief(s) Sought:
10.1. To kindly grant order, or Issue a direction or any other appropriate and direct the Respondents to pay adequate compensation/exemplary damages to the Petitioner for the substantial financial loss, mental harassment, and irreparable damage to the reputation of the Association caused by the arbitrary, last-minute cancellation. 10.2. Please kindly issue an order granting permission for our conference. 10.3. To kindly grant order for due action against the culpable officer. 10.4. To kindly grant any other suitable order or direction as this Hon'ble court may deem fit and proper in the facts and circumstances of the case, in the interest of justice’’
2. Learned State Counsel as well as learned counsel appearing for the Municipal Corporation, jointly submit that the petitioner had submitted an application before the concerned authorities seeking permission to convene a meeting of the Police Association. However, during the pendency of the present petition before this Court, the date and time fixed for the meeting have already elapsed. As such, present writ petition has become infructuous. 3. Per contra, learned counsel appearing for the petitioner submits that the scheduled date and time of alleged meeting have elapsed due to inaction on the part of the concerned respondent-authorities.
The Association proposes to convene another meeting in near future, for which, an appropriate application seeking permission is proposed to be
3 filed, hence, the concerned authorities may be directed to consider the same in a pragmatic manner and grant permission for convening the meeting. 4. Heard learned counsel for the parties and perused the writ petition. 5. Considering the aforesaid aspects of the matter, particularly the fact that the scheduled date and time for alleged meeting have already elapsed, the present writ petition is disposed of with a direction that, if the Association files an appropriate application before the concerned Collector seeking permission to convene another meeting, the Collector shall consider the same and pass an appropriate order granting permission to the Association to convene the meeting if there is no law-and-order impediment in this regard. CC as per rules. Sd/- (Amitendra Kishore Prasad)
