1. The present Criminal Miscellaneous Petition has been filed by the petitioner under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 for extension of time to deposit the fine amount in compliance of the judgment dated 17.09.2024 passed by this Court in Cr.A No. 594/2006.
2. The brief facts of the case are that the petitioner had earlier preferred Criminal Appeal No. 594 of 2006, which was partly allowed by this Court vide order dated 17.09.2024. Although this Court set aside the conviction of the petitioner under Section 307 of the Indian Penal Code SUMIT KUMAR Digitally signed by SUMIT KUMAR Date: 2026.09.08 18:40:23 +0530
2 and maintained his conviction under Section 325 of the Indian Penal Code. The petitioner was sentenced to the period already undergone and was further directed to deposit a fine of Rs. 25,000/- within a period of four months, failing which he shall undergo rigorous imprisonment for a period of two months.

Learned counsel for the petitioner would submit that the petitioner is the indigent person and has been facing financial hardship. He further submits that due to his ill financial ability and some miscommunication regarding funds arrangements, he could not arrange the same within the stipulated period as fixed by this Court. Since, there is a delay in paying the fine amount and therefore, he has filed the present petition for extension of time. He would further submit that the delay in payment of fine amount is bona fide. Therefore, the time may be extended to deposit the fine amount. In support of his submission, he would rely upon the judgment passed by Coordinate Bench of this Court in CrMP No. 405/2025 (Chakradhari Singh Vs. State of C.G.)

12.02.2025 and CrMP No. 745/2025 (Jay Kumar Vs. State of C.G.),
order dated 28/02/2025.
4. On the other hand, learned State counsel opposes the submission made by learned counsel for the petitioner.
5. I have heard learned counsel for the parties and perused the material annexed with the petition.
6. Considering the facts and circumstances of the case, submissions made by learned counsel for the petitioner and also the relief claimed by the petitioner for extension of time to deposit the fine amount for the
3 reason that to ill financial ability and the petitioner could not arrange the funds, this Court is of the considered opinion that the petitioner may be given one opportunity to deposit the fine amount as has been ordered by the judgment dated 17.09.2024.

Accordingly, keeping in view of the facts and circumstances of the present case as well as the orders passed by Coordinate Bench of this Court in Chakradhari Singh (Supra) and Jay Kumar (Supra), the time to deposit the fine amount in compliance of judgment dated 17.09.2024 passed by this Court in Cr.A. No. 594/2006 is extended and the petitioner is directed to deposit the same within a week from today before the learned trial Court. The rest of the terms and conditions of the judgment dated 17.09.2024 are remain as it is.
