Tripathy, AGA CORAM: JUSTICE B. P. ROUTRAY ORDER 16.01.2026 Order No. 01. 1. Heard Mr. S. Mohanty, learned counsel for the Petitioner and Mr. G. Tripathy, learned Addl. Govt. Advocate for State-Opposite Parties. 2. It is submitted on behalf of the Petitioner that the Tahasildar, Ersama (O.P. No.3) is proceeding to evict the Petitioner from his residential house without granting any opportunity of hearing to him. It is further submitted that though Encroachment Case No.4-71/2025 is shown to have initiated against the Petitioner, but no such notice has been served upon the Petitioner in the said encroachment case. 3. Considering the limited prayer of the Petitioner, the writ petition is disposed of at the stage of admission with a direction to the Tahasildar, Ersama (O.P. No.3) to grant an opportunity of hearing to the Petitioner before proceeding for his eviction from the land in question, and take the decision in accordance with law, within a period of one month from the date of receipt of the certified copy of this order along with a copy of the writ petition.
