The learned counsel for the petitioner has submitted that learned Chief Judicial Magistrate, South Andaman District, Port Blair has wrongly passed the order dated 29.08.2025 in Misc. Case No. 52 of 2023 whereby the learned Chief Judicial Magistrate has only stated that he is not satisfied with the submission of the EO and the case requires thorough investigation.
Mr. Halder, learned counsel has submitted as the said order does not contain any reason, the same is not sustainable in law, and accordingly the petitioner prays for quashing of the FIR lodged against him being FIR No. 134 of 2025 of Aberdeen Police Station.
The learned counsel for the State has submitted that the FIR cannot be treated to be an encyclopedia of facts and there are several judicial decisions over the issue. The Police should be given sufficient opportunity to investigate the matter and thereafter to submit the result of the investigation in final form.

At this preliminary stage the FIR should not be quashed without thorough investigation. The learned counsel appearing for the complainant has drawn the attention of this Court to Preliminary Inquiry Report. I have gone through the materials on record including the Preliminary Inquiry Report wherefrom it is found that the CCTV footage has been analyzed and it goes to show that the FIR has certain merits. Accordingly, I find nothing wrong in the order of the learned Chief Judicial Magistrate dated 29.08.2025, and as such I am not willing to interfere with such observation of the learned Chief Judicial Magistrate at this stage. Accordingly, the present criminal revisional application being CRR/6/2026 is hereby dismissed. No costs.
