JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court, seeking the following prayers: "a) Call for the records in PCR No.152/2026 pending on the file of the Hon'ble 48th ACJM, Bangalore. b) Set aside the Order dt:27.02.2026 at Annexure- A passed by the Hon'ble 48th ACJM, Bangalore based on the offences alleged in the complaint filed by the Respondent. c) Quash the complaint on the file of the Hon'ble 48th ACJM, Bangalore in PCR No.152/2026 in the interest of justice at Annexure - C. d) Pass such further order or orders as this Hon'ble Court may deem fit in the Interest of Justice and equity." - 3 - HC-KAR CNR: KAHC010269862026 NC: 2026:KHC:39048 CRL.P No. 5838 of 2026 2. Heard the learned Senior counsel, Sri. K. Kasthuri appearing for the petitioners and the respondent-party-in- person and have perused the material on record. 3. The respondent is the complainant, registers a complaint invoking Section 223 of the BNSS, 2023, which is registered as PCR No.152/2026 for plethora of offences. The issue is not with regard to the offence as necessary under Section 223(1) and (2) of the BNSS, 2023. A pre-cognizance notice is issued to the accused - the present petitioners. Immediately thereafter, the petitioners are before this Court calling in question the said pre-cognizance notice. 4. In the light of no order being passed that would cause prejudice to the petitioners, there is no warrant of entertainment of the petition at the pre-cognizance notice stage. In the event, the cognizance is taken by the concerned Court, the petitioners are at liberty to knock the doors of this Court, yet again. 5.
