The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.257/2026, registered at Police Station Simga, District Balodabazar (C.G.) for alleged commission of offence punishable under Section 34 (2) of the Excise Act. 2. As per the case of the prosecution, on 10-06-2026, a secret information was received by the police that a motor cycle is carrying Deshi Liquor and is going from Nandghat to Limtara. On the basis of such information, the police intercepted the vehicle i.e. numberless Bajaj Pulsur and accused, Arvind Banjare, fled after abandoning the said vehicle, 98 quarter bottles (17.640 bulk litres) of Deshi liquor, and an Oppo mobile phone. The articles were seized in accordance with law, and a case was registered against the accused under Section 34(2) of the Excise Act. Hence, the bail application.

Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in the present case. He further submits that the applicant has not acted in the manner as it is alleged by the prosecution. A false seizure memo has been prepared by the police in order to rope the applicant in a false criminal case. Hence he prays to enlarge the applicant on anticipatory bail.

On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submitted that the applicant has 5 criminal antecedents registered against him under the Excise Act, NDPS Act and the IPC, out of which in 2 cases, the applicant has already been acquitted whereas 3 cases are pending. Therefore, the anticipatory bail application of the applicant deserves to be rejected.

5. I have heard learned counsel for the parties and perused the case diary.

Considering the submissions of learned counsel for the parties, particularly considering that the applicant has 5 criminal antecedents registered against him under the Excise Act, NDPS Act and the IPC, out of which in 2 cases, the applicant has already been acquitted whereas 3 cases are pending, and the applicant seems to be a habitual offender, I am not inclined to grant anticipatory bail to the applicant.

Accordingly, the anticipatory bail application of the applicant - Arvind Banjare, involved in Crime No.257/2026, registered at Police Station Simga, District Balodabazar (C.G.) for alleged commission of offence punishable under Section 34 (2) of the Excise Act, is rejected.
