1. The petitioner has filed the instant petition seeking the following reliefs:-
“10.1 That, this Hon’ble Court may kindly be pleased to call for entire records of the case, from the respondent authorities. 10.2 That, this Hon’ble Court may kindly be please to direct to the respondent no. 1 to 5 to remove the alleged encroachment of respondent no. 6 to 8 from part of the government land bearing khasra no. 1160/1 admeasuring area 0.1500 hectare situated at Village Newsa, Tahsil-Beltara, District Bilaspur (C.G.), is in the interest of justice. 10.3 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.”
2. Learned counsel for the petitioner submits that the petitioner has made a complaint before the concerned authorities alleging that respondent Nos. 6 to 8 are raising illegal construction over
3 government land situated in front of the petitioner’s land, thereby causing hardship to the petitioner. He next submits that, as the private respondents are proceeding with the construction at a rapid pace, the order passed by the concerned Tehsildar, Beltara, Bilaspur (C.G.), directing removal of the encroachment, is required to be implemented expeditiously, particularly when the said order has already been passed against private respondent Nos. 6 to 8.
3. Learned State counsel, on instructions, submits that an appeal against the order passed by the Tehsildar, Beltara, Bilaspur (C.G.), has already been preferred before the S.D.O. (Revenue), Bilaspur (C.G.).
4. Learned counsel for the petitioner at this stage submits that he has not even received the notice etc.
5. Having heard learned counsel for the parties and upon
consideration of the aforesaid facts and circumstances of the case, this Court is of the view that the petitioner may approach the S.D.O. (Revenue), Bilaspur (C.G.) and pursue the appeal preferred by respondent Nos. 6 to 8 against the order passed by the Tehsildar, Beltara, Bilaspur (C.G.). In the event any such appeal is pending before the S.D.O. (Revenue), Bilaspur (C.G.), the petitioner shall be afforded an opportunity of hearing before passing an appropriate order in accordance with law. If the petitioner has not been impleaded as a party in the said appeal,
4 the concerned authority shall ensure that the petitioner is afforded an opportunity of hearing, having regard to the fact that he is the complainant/whistle blower in the matter. The petitioner shall approach the concerned S.D.O. (Revenue), Bilaspur (C.G.) within 07 working days from today along with a copy of this order. Thereafter, the S.D.O. (Revenue), Bilaspur (C.G.) shall proceed in accordance with law and endeavour to decide the pending appeal, preferably within a period of 30 days from the date of receipt of a copy of this order, after affording due opportunity of hearing to all concerned parties.
6. With this observation and direction, the petition stands disposed of.
