[2026:RJ-JP:11001] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 17189/2025 Sumit Son of Prahalad, Resident of Harijan Basti, Nehar Ke Pass, Tulla Pura, Currently Sogariya, P.S. Railway Colony, Kota (Rajasthan) (At Present Confined In District Jail Kota) ----Accused Petitioner/Applicant Versus State of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Mr. Paras Jain For Respondent(s) : Mr. Manvendra Singh Choudhary, PP HON'BLE MRS. JUSTICE SANGEETA SHARMA Order 16/03/2026 1. This bail application has been filed on behalf of the accused- petitioner under Section 483 of B.N.S.S. in connection with FIR No. 244/2025 registered at Police Station RLY Colony, District Kota City for the offence(s) under Sections 115(2), 126(2), 118(1), 109(1) and 3(5) of BNS, 2023. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has been falsely implicated in this case. He further submits that the charge-sheet against the accused- petitioner has already been filed and the accused-petitioner is behind the bars since 07.10.2025. He further submits that the co-accused Sanjay has already been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 28.11.2025 in S.B. Criminal Miscellaneous Bail Application No. 14621/2025 and the other co-accused namely Amit has also been enlarged on bail [2026:RJ-JP:11001] (2 of 3) [CRLMB-17189/2025] by the Juvenile Board itself. (This fact is not rebutted by the learned Public Prosecutor). He further submits that there is no criminal antecedents against the accused-petitioner and conclusion of trial may take long time, so no fruitful purpose would be served by keeping the accused-petitioner in custody and therefore, prays that the accused-petitioner may be granted the benefit of bail under Section 483 of BNSS. 3. Per contra, learned Public Prosecutor vehemently opposes the submissions made by learned counsel for the accused- petitioner hereinabove. 4. Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced by learned counsel for the parties that the accused-petitioner is behind the bars since 07.10.2025 and the charge-sheet against the accused- petitioner has already been filed. Co-accused persons have already been enlarged on bail and trial will take considerably long time in its conclusion. Without expressing any opinion on the merits/demerits of the case, this Court deems it just and proper to enlarge the accused-petitioner on bail. 5. Therefore, this bail application under Section 483 BNSS is accordingly, allowed and the accused-petitioner Sumit Son of Prahalad is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the trial Court, with the stipulation that he shall appear before that Court and any court to which the matter is transferred on all subsequent dates of hearing and as and when called upon to do so.
