2 07.09.2026 1) At the very outset, learned counsel for the respondents submits that this writ petition is not maintainable as the petitioner has challenged the order of removal from services dated 16.09.2021 passed by the disciplinary authority and he has statutory remedy to prefer a departmental appeal before the appropriate appellate authority. 2) At this stage, learned counsel for the petitioner seeks permission of this Court to withdraw this writ petition with liberty to prefer a duly constituted departmental appeal before the appellate authority. 3) No objection from other side. 4) Permission granted. Accordingly, this writ petition is dismissed as withdrawn with the aforesaid liberty. 5) If the petitioner prefers appeal before the departmental appellate authority, it is expected that the authority concerned shall consider and decide the appeal expeditiously, strictly in accordance with law.
