Samudram Mandal, Anantapur District basing on the illegal proceedings of 4th respondent under order in R.C.No.244/2014 (B) dated, 09-07-2015 as illegal, arbitrary. void and against the principles of natural justice, unconstitutional, and also against the Assignment Law applicable to the state of A.P and consequently direct the respondents 3 and 4 to set aside the proceedings issued in R.C,No.244/2014 (B) dated, 09-07- 2015 and protect the petitioners right, title and possession over the land bearing Sy.No.3-2 extent 3.35 cents situated at Bodiganidoddi village, B.K. ORDER:
This Writ Petition came to be filed under Article 226 of the Constitution of India, seeking the following prayer:
“to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring action of the interfering in the petitioner's land bearing Sy.No. 3-2 extent of Ac.3-35 situated at Bodiganidoddi village, B.K. Samudram Mandal, Anantapur District basing on the illegal proceedings of 4th respondent under order in R.C.No.244/2014 (B) dated, 09-07-2015 as illegal, arbitrary. void and against the principles of natural justice, unconstitutional, and also against the Assignment Law applicable to the state of A.P and consequently direct the respondents 3 and 4 to set aside the proceedings issued in R.C,No.244/2014 (B) dated, 09-07-2015 and protect the petitioners right, title and possession over the land bearing Sy.No.3-2 extent 3.35 cents situated at Bodiganidoddi village, B.K. Samudram Mandal, Anantapur District and pass”

Brief facts of the case are that the land admeasuring Acs.3.35 cents in Sy.No.3-2 of Bodiganidoddi village, B.K. Samudram Mandal, Anantapur district was assigned in favour of the petitioner‟s husband in the year 1980 and the same devolved upon the petitioner after his demise; pattadar pass book and title deed were also issued by the concerned authorities in favour of the petitioner and ever since, she has been in possession of the subject land. 4 VS,J W.P.No.16283 of 2018
3. While the matter stood thus, the 4th respondent, basing on a representation submitted by one S. Venkatesulu – 5th respondent, ordered to change survey number, extent and pattadar name in D.A.R. Dis.No.61/1419, dated 26.12.2009 vide R.C.No.244/2014-B-7, dated
09.07.2015. Pursuant to the same, as the respondent authorities were interfering with the peaceful possession of the petitioner over the subject land, the petitioner was constrained to file the present writ petition. 4. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue. 5. Today when the writ petition came up for hearing, learned Assistant Government Pleader has furnished a copy of instructions of the 4th respondent dated 23.06.2026 wherein it is stated that as per re- settlement register – RSR (Diglot), the land bearing Sy.No.3 admeasuring Acs.20.14 cents is classified as G.D., „Dotted land‟ and was subdivided, D- pattas were also issued to the concerned as per their enjoyment on the ground. In the said course, the land to an extent of Acs.3.35 cents in Sy.No.3-2 of the subject village was assigned in the name of the petitioner‟s husband and after his demise, the land was mutated in favour of the petitioner. While so, the respondent No.5 submitted a representation stating that he was granted D-patta for the land admeasuring Acs.3.50 cents in Sy.No.3-6, however, during survey it came to light that he is in actual possession of Acs.3.35 cents in Sy.No.3-2. 5 VS,J W.P.No.16283 of 2018
Basing on the same, a detailed survey was conducted by the authorities and as per the survey report, the authorities recommended for change of survey number of the 5th respondent‟s land and to issue revised D-patta to the concerned.
Pursuant to the same, the 4th respondent issued notices to all the concerned including the petitioner calling for an enquiry and for raising objections if any; as the petitioner did not attend the said enquiry, basing on records, the 4th respondent issued impugned proceedings for change of survey number of the 5th respondent in the D-patta. 6. It is further stated that a re-survey was conducted in the year 2022-2023, where, an opportunity was given to all the enjoyers to seek rectification of the field mistakes, if any; for which, the petitioner has not raised any objection and thus, the respondents allotted the following L.P.Numbers to the petitioner and the 5th respondent: i.LP No.13, Acs.3.30 cents (old S.No.3-1) – K. Nagalakshmamma W/o Yerri Nagappa (petitioner) ii. LP No.19 (Old S.No.3-2), Acs.4.05 cents – S. Venkatesulu S/o Naganna (5th respondent)
7. Perused the entire material available on record. It can be seen from the instructions that pending the present petition, a re-survey was conducted over the subject land during 2022-2023 and L.P., numbers were also allotted to the petitioner and as well as the 5th respondent as mentioned hereinabove as per their enjoyment. In view of the same, this

Court is of the opinion that the no further orders are necessary in the present writ petition. 8. Accordingly, this writ petition is closed. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Petition shall stand closed. _____________________
