CRM-M-41563-2026 (O&M) 1 IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH. 104 CRM-M-41563-2026 (O&M). Date of Decision: 29.07.2026. Jashandeep Singh @ Jaskarandeep Singh ....Petitioner. VERSUS State of Punjab ....Respondent. **** CORAM : HON'BLE MR. JUSTICE SANJAY VASHISTH --- Present: None. **** SANJAY VASHISTH, J. (Oral) On a call given by the Executive Committee of the Punjab and Haryana High Court Bar Association, the Members of the Bar have suspended the work from 28.07.2026 (Post Lunch) till 30.07.2026 in protest against the implementation of the Legal Aid Defence Counsel (LADC), Policy. 1. Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name of petitioner(s) FIR No. Date Section(s) Police Station District Jashandeep Singh @ Jaskarandeep Singh 71 18.05.2025 125 of BNS and 25, 27 of Arms Act Jhabal Tarn Taran
2. At first instance, petitioner filed anticipatory bail before the Court of Sessions at Tarn Taran wherein on 18.06.2025, while granting anticipatory bail, petitioner was directed to join investigation before the IO/SHO of Police Station Jhabal, District Tarn Taran. JITENDER 2026.07.30 12:27 I attest to the accuracy of this document
CRM-M-41563-2026 (O&M) 2 Subsequently, on account of non joining of the investigation with the concerned IO, application was dismissed, vide order dated 07.07.2025. 3. Again on 06.12.2025, second anticipatory bail petition was filed i.e. BA-7989 dated 06.12.2025 before the same Court (Additional Sessions Judge, Tarn Taran), and the same was dismissed, vide order dated 17.12.2024. 4. Again third attempt has been made by filing the present petition under Section 482 of BNSS before this Court for getting the same relief. 5. Since the concession sought by the petitioner had already been extended to him by the Court below itself, it was on non-compliance of the condition incorporated in the order, that the application was dismissed. Therefore, to the view point, not only the petition before this Court, even the second anticipatory bail application before the Court of Sessions was not maintainable. 6. In view of the above, the present petition is dismissed.
However, liberty is granted to the petitioner to assail the order to seek modification/ one more chance to join investigation, in the order whereby first anticipatory bail application filed by the petitioner was dismissed on 07.07.2025. The Court is well aware of the situation that Bar Members are not appearing in protest against the implementation of the Legal Aid Defence Counsel (LADC), Policy (as mentioned hereabove also), therefore, the Court itself examined the issue and to avoid any further wastage of time, instead of adjourning the present petition, aforementioned liberty has been granted.
