The complainant has filed the present complaint alleging willful disobedience of the order dated 08.09.2025 passed by the V Additional Principal Judge, Family Court, Bengaluru [Family Court] in M.C. No.5936/2022. 2. The accused had entered into a settlement for dissolution of the marriage in the mediation proceedings. The parties entered into a Memorandum of Settlement, whereby the complainant had agreed to pay a sum of `5,00,000/- towards permanent alimony/maintenance as full and final settlement. The said amount was handed over to the accused and parties consented for the - 3 - HC-KAR CNR: KAHC010439132026 NC: 2026:KHC:41839-DB CCC No. 770 of 2026 dissolution of the marriage. The parties had also agreed that they would not press the allegations against each other in the other connected cases. 3. The complainant alleges that the accused has not withdrawn the criminal case as agreed in the Memorandum of Settlement and that the same constitutes willful disobedience of the order passed by the Family Court. According to the complainant, the terms of the settlement have been breached. 4. We are unable to accept that any proceedings under the Contempt of Courts Act, 1971 are required to be initiated. The complaint is accordingly closed. 5. However, we clarify that this order will not preclude the complainant from availing of the remedies in respect of any alleged breach of the terms of the settlement.
