JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioner seeks the following reliefs: "a) Issue a Writ of certiorari to quash the order dated 15/01/2026, bearing NO.E- 38019/02/2025/SOS/STA-DA/468, passed by the 3rd Respondent, vide Annexure-A. b) Issue a Writ of mandamus directing the Respondents to transfer the Petitioner to his Home Zone as per Circular No.07/2024 dated 23.12.2024 No.E-38011/1/2024/EST.II/4009 and as per their undertaking by way of a written communication dated 31/05/2025, bearing NO.E-38014/ANNUAL TRANSFER-2025/sta-ii/1543, vide Annexure-E. c) Pass such other order or orders as this Hon'ble Court deems fit to grant under the facts and circumstances of the case, including costs of the proceedings, in the interest of justice and equity." 2. Heard the learned counsel for the petitioner and learned CGC for respondent Nos.1 to 5 and perused the material on record. 3. In addition to reiterating the various contentions urged in the petition and referring to the material on record, learned counsel for the petitioner invited my attention to the intimation at Annexure-E dated 31.05.2025 enclosing the list of the employees including the petitioner at Sl.No.816 in the - 4 - HC-KAR NC: 2026:KHC:18769 WP No. 10074 of 2026 Annexed list in order to contend that despite the said intimation, the request of the petitioner for posting to DMRC Delhi, CGBS New Delhi or National Museum New Delhi has been rejected by the respondents by issuing the impugned endorsement at Annexure-A dated 15.01.2026, aggrieved by which, the petitioner is before this Court by way of the present petition. 4. A perusal of the impugned endorsement will indicate that the intimation at Annexure-E containing the list of persons including the petitioner at Sl.No.816 has not been considered by the respondents, while passing the impugned order, declining the request for posting to DMRC Delhi, CGBS New Delhi or National Museum New Delhi. 5. Under these circumstances, without expressing any opinion on the merits/demerits of the rival contentions, I deem it just and appropriate to set aside the impugned endorsement at Annexure-A dated 15.01.2026 insofar as petitioner-Naresh Pal is concerned and remit the matter back to the respondents for reconsideration afresh in accordance with law. - 5 - HC-KAR NC: 2026:KHC:18769 WP No. 10074 of 2026 6. In the result, the following: ORDER i) Writ petition is hereby allowed. ii) Impugned Endorsement/order dated 15.01.2026 passed by respondent No.3 is hereby set aside. iii) Matter is remitted back to the respondents for reconsideration afresh within a period of one month from the date of receipt of a copy of this order in accordance with law.
