The present Intra Court Appeal has been filed by impugning the judgment and order dated 06.04.2026 passed by the Writ Court in Writ Petition No.34614/2025 filed by the appellant assailing the order dated 18.10.2025 passed in Industrial Dispute No. 17/2024 by the Labour Court, Kolar. The Labour Court vide
order dated 18.10.2025 has allowed I.A.No.III filed by the Management to frame an additional issue on question of delay and latches.

2. The Writ Court after considering the contentions and the judgments cited on behalf of the petitioner has reframed the issue as under:
“Whether the claim made by the petitioner is hit by delay and laches?”
3. We do not find that there is any error of law or appreciation of the facts by the learned single Judge. The question of delay and laches goes to the root of the matter and the competent Court that is may be the labor Court or the industrial Tribunal are competent to look into that issue. Therefore, we find no substance in this appeal. We, therefore, dismiss this appeal.
