The present contempt application has been preferred alleging violation of an order dated 8th April, 2025 passed by this Court in a writ petition being WPA 188 of 2025. Pursuant to the earlier orders of this Court, an affidavit of compliance and a supplementary affidavit of compliance have been filed on behalf of the alleged contemnor. An exception to the same has also been filed on behalf of the petitioner. Ms. Mini, learned advocate appearing for the petitioner contends that the respondents have not conducted any physical inspection and demarcation, upon prior notice to the petitioner, in spite of the
2 specific direction of this Court. A mandatory direction of this Court has thus been violated. Drawing the attention of this Court to the averments made and the documents annexed to the compliance report and the supplementary affidavit, Ms. Das, learned advocate appearing for the alleged contemnor submits that a field inspection was conducted on 6th May, 2025 upon prior notice to the petitioner. The records reveal that a notice was duly issued and accepted by the petitioner’s son prior to demarcation of the land and as such the contention of Ms. Mini that no prior notice was issued is not acceptable. Considering the inspection report of the Tehsildar, the Sub-Divisional Officer, South Andaman has also passed an order on 21st July, 2025 complying with the directions of this Court. In view thereof, there has been no deliberate violation of the order passed by this Court and accordingly, the contempt application being CPAN 37 of 2025 is dismissed. There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all requisite formalities.
