Notice to the respondents is dispensed with in view of the proposed order to be passed. - 3 - HC-KAR CNR: KAHC010513972026 NC: 2026:KHC:40487 WP No. 23305 of 2026 2. The Petitioner is before this Court seeking for the following reliefs: (i) Pass an appropriate Order or Writ quashing the Order dated 4/7/2026, passed on I.A. No.1 in MVC No.3845/2025 as per Annexure "D", passed by the Court of the VIII Addl Judge and ACJM Member MACT Bengaluru and (ii) Pass such other Writ or Order or Orders as this Hon'ble Court deems fit, under the facts and circumstances of the case, in the interest of justice and equity. 3. Respondent Nos.1 and 2 had filed proceedings in MVC. No.3845/2025, seeking for compensation on account of the accident which occurred on 09.01.2025. The respondents therein being the Owner of the vehicle being respondent No. 4 and the Insurer of the said vehicle being the petitioner herein. 4. In the said proceedings, the Insurer had filed an application to implead the Owner and Insurer of the other vehicle which had been involved in the accident. The said application came to be dismissed - 4 - HC-KAR CNR: KAHC010513972026 NC: 2026:KHC:40487 WP No. 23305 of 2026 by way of order dated 04.07.2026. It is challenging the same, the Petitioner-Insurer is before this Court seeking for the aforesaid releifs. 5. The submission of learned counsel for the Petitioner is that the other vehicle involved in the accident as also its insurer are required to be brought on record for effectively adjudicating the disputes. Inasmuch as the driver of that vehicle was negligent resulting in the accident. The MACT has considered the charge sheet filed in Crime No.11/2025 by the Nelamangala Police arising out of the very same accident and has come to a conclusion that the negligence in the charge sheet has been attributed to the driver of the vehicle insured by the Petitioner and there is no whisper of any rash or negligent driving of a driver of the car whose owner is now sought to be brought on record as the respondent. - 5 - HC-KAR CNR: KAHC010513972026 NC: 2026:KHC:40487 WP No. 23305 of 2026 6. There being no particular allegation made against the said driver of the car, the question of impleading the owner of the car and the insurer of the car would not arise.
