Today the learned advocate for the respondent no.4 has placed before this Court a copy of the order dated 16th April 2012 passed in Misc. Case No.79 & 80/2007 pertaining to premises no.23B, 23D, 23E, 23F, 23J, 23K and 23N, Radha Madhab Dutta Garden Lane passed by the Office of the Controller, Kolkata Thika Tenancy. 2. Having regard to the disclosure made, Ms. Chowdhary, learned advocate representing the petitioners would submit that though the petitioners are the owner in respect of the premises in question and though the petitioners were entitled to a notice in a proceeding under section 5(3) of the West Bengal Thika Tenancy (Acquisition & Regulation) Act, 2001, no such notice was served on the petitioners. 2 3. In that peculiar fact as noted above, the learned advocate representing the petitioners seeks leave to withdraw the instant writ petition so that she can take appropriate steps against the private respondent including the order passed in Misc. Case No.79 & 80/2007 disclosed as above. 4. Having regard thereto, the writ petition stands dismissed as withdrawn. (RAJA BASU CHOWDHURY, J.) R. Bose
