Mr. Anirban Banerjee Mr. Swarup Mondal ……for the Petitioner. Mr. Janardan Periwal, JPP Ms. Ruchika Agarwala, Mr. Mayank Bhandari ……for the State. 1. The petitioner says that he has been framed in this matter. Both the victim and he are married persons. They met through face book. There was an affair between them. The false complaint has been lodged upon such affair having become known to people. Charge sheet has been submitted. 2. Learned State Counsel opposes the prayer for pre arrest bail. He shows me the material in the case diary including the statement of the victim lady recorded under Section 183 B.N.S.S. 2023. The allegation is that the petitioner established physical relationship with the victim lady by meting out false promise to marry. 3. Given the nature of the allegation and that both the petitioner and the victim lady are married persons I am 2 of the view that immediate custodial interrogation of the petitioner may not be necessary so long as he cooperates with the Investigating Officer in case of further investigation. 4. Accordingly, in the event of arrest, the petitioner, namely Amit Kumar Oraon shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that he shall report to the Officer in charge of the jurisdictional Police Station once in a month until further orders and on further condition that the petitioner will not intimidate or try to contact the victim lady. 5. 5. In case the petitioner fails to adhere to any of the conditions mentioned in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 6. CRM (A) 649 of 2026 stands disposed of. 7. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Arijit Banerjee, J.) 3
