…for the State. 1. The allegation is under Section 108 of Bharatiya Nyaya Sanhita, 2023 (corresponding to Section 306 of the Indian Penal Code, 1860). The petitioner says that he has no role to play in the suicide of his wife. His wife never even came to reside in the matrimonial home after the marriage. She stayed back in her paternal house. The petitioner prays for pre-arrest bail. 2. Learned State Counsel says that the petitioner used to quarrel with the victim and threaten her over telephone as has been stated by the parents of the victim while recording their statements under Section 180 of Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 161 of the Criminal Procedure Code, 1973). 2

On an overall consideration of the facts and circumstances of the case and the possible degree of complicity of the petitioner in the alleged crime, I am of the opinion that immediate custodial interrogation of the petitioner may not be necessary, so long as he fully co-operates with the Investigating Officer. 4. Accordingly, in the event of arrest, the petitioner, namely, JABEDUL ISLAM shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand), with two sureties of Rs.5,000/- (Rupees Five Thousand) each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Jalpaiguri and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023, until further orders and on further condition that the petitioner shall meet the Investigating Officer of this case as and when called for, until further orders. Within three days from date the petitioner shall go and meet the Investigating Officer of this case. 5.
In case the petitioner fails to adhere to any of the conditions stipulated above, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 6. The application for anticipatory bail being CRM(A)/628/2026 is accordingly disposed of. 3
