And In the matter of : Sadhan Barman & Ors. ……Petitioners. Mr. Nilay Chakraborty, Ms. Angana Rakshit, Ms. Avisikta Das, ……for the Petitioners. Ms. Panchali Deb Sikdar (Nag), Mr. Bapi Sarkar, Mr. Mayank Bhandari, ……for the State. 1. The allegation is under Sections 498A/304 of the Indian Penal Code. The victim lady died about 11 months after her marriage. The husband was arrested and was granted bail after 85 days in custody. The petitioner no.1 is the maternal uncle of the victim’s husband and the other petitioners are also relatives of the victim’s husband. The petitioners pray for pre-arrest bail. 2. From the case diary I have seen the statement of witnesses recorded under Section 180 of the B.N.S.S. Chargesheet has been filed upon completion of investigation. 2 3. On an overall assessment of the facts and circumstances of the case, I am of the opinion that immediate custodial interrogation of the petitioners may not be necessary so long as they co-operate with the Investigating Officer, if there is further investigation. 4. Accordingly, in the event of arrest, the petitioners, namely Sadhan Barman, Madan Barman, Santana Barman and Maya Barman shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that they shall meet the Investigating Officer of this case as and when called for until further orders. Within three days from date the petitioners shall go and meet the Investigating Officer of this case and on further condition that they shall present before the learned Trial Court on each and every date of hearing. 5. In case the petitioners fail to adhere to any of the conditions mentioned in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned 3 Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 6. The application for anticipatory bail, being CRM (A) 634 of 2026, stands disposed of. 7. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
