Mr. Prajnadeepta Roy, Mr. Sabir Ali, Mr. J. Bhattacharya ……for the Petitioner. Mr. Avrojyoti Das, ld. APP Mr. Arko Sarkar, Ms. Baishali Chakraborty……for the State. 1. The petitioner says that there was no recovery of narcotics from him. His implication is on the basis of statement made by a co-accused person from whom recovery was made. He prays for pre arrest bail. 2. Learned State Counsel files a report from which it appears that the petitioner does not have criminal antecedents. Admittedly, no narcotic was seized from him. Nothing has been placed on record in the form of CDR or money trail which would indicate the involvement of the petitioner in the alleged crime, at least prima facie. 2 3. In view of the aforesaid, I am of the opinion that immediate custodial interrogation of the petitioner may not be necessary so long as he fully cooperates with the Investigating Officer. 4. Accordingly, in the event of arrest, the petitioner, namely Majahar Ali shall be released on bail upon furnishing a bond of Rs.25,000/-, with two sureties of Rs.12,500/- each, one of whom must be local, to the satisfaction of the arresting officer and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that he shall report to the Investigating Officer within three days from date and as and when called for, until further orders and on further condition that the petitioner will not leave the territorial jurisdiction of Sahebganj Police Station without the leave of the Investigating Officer until further orders. 5. 5. In case the petitioner fails to adhere to any of the conditions mentioned in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 6. CRM (A) 621 of 2026 stands disposed of. 3 7. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Arijit Banerjee, J.)
