This petition has been preferred by petitioner under Article 226 of the RUKHSAR BANO Digitally signed by RUKHSAR BANO Date: 2026.01.30 10:39:47 +0530 2 Constitution of India seeking following reliefs :- “10.1 That, this Hon'ble court may kindly be pleased to restrain the respondent authorities to not make any construction/not made any other activities /not dispossessed the petitioner from the subject land, bearing Khasra no. 136 Rakba 3.49 hectare situated at village- Balrampur till the final decision of the application for grant of Van Adhikar Patta of the subject land. 10.2 That, this Hon'ble court may kindly be pleased to direct the respondent no. 3 to consider/ decide the application of the petitioner for grant of Van Adhikar Patta of the subject land as early as possible. 10.3 That, any other relief or reliefs may also be granted to the petitioner which this Hon'ble court deems fit and proper in the facts and circumstances of the case.” 3. Learned counsel for the petitioner submits that the petitioner is a widow. She has been in possession over 1 hectare of land out of Khasra No.136, area 3.49 hectares, situated at Village Balrampur, since the time of her ancestors, by constructing house on a portion of the said land and has been cultivating the remaining portion. (Learned counsel further submits that in the writ petition, the possession of petitioner has been wrongly mentioned as 3.49 hectares instead of 1 hectare). He further submits that the petitioner and her ancestors have been in possession over the said 1 hectare of land for about 75 years, but respondent authorities are now going to construct a Girls’ College over the said land. He also submits that the petitioner has submitted an application dated 08.12.2023 (Annexure -P/4) before the Collector, 3 Balrampur, District Balrampur-Ramanujganj, seeking grant of lease of the said 1 hectare of land, to which, the Sub-Divisional Officer (Revenue), Balrampur has also made a communication dated 29.12.2023 to the Chief Municipal Officer, Municipal Council, Balrampur, but no action has been taken for grant of forest rights/lease to the petitioner. Lastly, learned counsel prays that this petition may be disposed of with a direction to the Collector, Balrampur, District Balrampur-Ramanujganj (respondent No.3) to decide the petitioner’s application dated 08.12.2023 (Annexure -P/4), within a period specified by this Court. 4. In reply, learned counsel appearing for the State-respondents submits that the application (Annexure -P/4) filed by petitioner shall be decided in accordance with law. However, he does not object to the limited prayer made by learned counsel for the petitioner. 5. As per contention made by learned counsel for petitioner, the petitioner is a widow lady and having possession on 1 hectare of land out of total area 3.49 hectare of Khasra No.136 for about 75 years. She has also filed application (Annexure -P/4) seeking grant of lease in her favour. The communication dated 29.12.2023 has also been made by the SDO (Revenue), Balrampur to the Chief Municipal Officer, Municipal Council, Balrampur, but even after lapse of 2 years, the application of petitioner has not been decided by the Collector/concerned committee. Therefore, considering the limited prayer made by the petitioner, this petition is disposed of directing the Collector, Balrampur/ concerned committee to consider and decide the application dated 08.12.2023 (Annexure -P/4) filed by the petitioner, in accordance with law, expeditiously, preferably within a period of 60 days from the date of 4 receipt/submission of a copy of this order, taking liberal view in favour of petitioner, as she is not only a widow but also belongs to the Uraon Tribal community. 6. With aforesaid observation and direction, the writ petition stands disposed of. 7. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
