Ms. Panchali Deb Sikdar (Nag), Mr. Gobinda Saha, Mr. Mayank Bhandari, ……for the State. 1. The allegation is under Section 85 of the B.N.S. corresponding to Section 498A of the Indian Penal Code and other provisions of criminal law. 2. The petitioner is the husband of the victim lady. The allegation is that the petitioner and his family members meted out physical and mental torture to the victim who got married to the petitioner in 2017. On December 22, 2025, the victim escaped from the matrimonial home and took refuge in her paternal house. 3. The petitioner says that the allegations are completely false. The victim left the matrimonial home on her own 2 volition. The petitioner has filed a suit for restitution of conjugal rights. A few days thereafter, this false complaint was lodged. 4. I have considered the facts and circumstances of the case. There is a delay of about eight months in lodging the FIR after the victim left the matrimonial home. 5. Considering the nature of the allegations and the possible extent of complicity of the petitioner in the alleged crime, I am of the opinion that immediate custodial interrogation of the petitioner may not be necessary so long as he co-operates with the Investigating Officer. 6. Accordingly, in the event of arrest, the petitioner, namely Chiranjit Banik @ Chiranjit Bonik shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that he shall meet the Investigating Officer of this case as and when called for until further orders. Within three days from date the petitioner shall go and meet the Investigating Officer of this case. 3 7. In case the petitioner fails to adhere to any of the conditions mentioned in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 8. The application for anticipatory bail, being CRM (A) 637 of 2026, stands disposed of. 9. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
