Heard Mr. Gyan Prakash Shukla, learned counsel for the petitioner. Also heard Mr. Shashank Thakur, learned Additional Advocate General, appearing for the respondents/State. 2. By way of this petition styled as Public Interest Litigation, the petitioner has prayed for following relief:- “10.1 That, this Hon'ble Court may graciously be pleased to accept the instant writ petition as a public interest petition. 10.2 That, to direct the respondents authorities to 3 restrain the mines lease holders and sand storage permit holder from extracting the sand other than areas allotted to them and to scrutiny the quantity of sand cubic meter available in their allotted khasra numbers. 10.3 That, direct the respondents officials to scrutiny the transit pass book and same is required to be compared with the transit pass (TP) of mines department. 10.4 That, direction may be issued to official respondents to seize the vehicles (JCB, Truck and Trailers) that are engaged in illegal extraction of the sent from unauthorized area. 10.5 That, necessary direction may be passed this Hon'ble High Court for initiation of proper inquiry against the concerned officers involved in misappropriation of funds by levying inappropriate fines/charges in the case of overloading and take appropriate action against them. 10.6 That, to award the cost and expenses of this petition. 10.7 That, to issue any other writ or directions or order in favour of the petitioner and against the respondent upon these facts and in the circumstances of the case, in the interest of justice and equity.” 4 3. Learned counsel for the petitioner submits that the present WPPIL has become infructuous. 4. Accordingly, the present petition is dismissed as having become infructuous.
