particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in not releasing Uie admilled/finalized amount to the petitioner for the completed work I.e., O M of CPWS Scheme at Ravulaparru and 12 other Habitations in Unguturu Mandal, under M- Book No.224B/RWS/S/ D/E/r 2017-18 for amount of Rs. 1,74,187/- as illegal, arbitrary, and violative of Articles 1 21 of the Constitution of India and also oppose to all cannons of justice, and consequently direct the respondents to forthwith release the due amount to the petitioner pending towards the completed work I.e., O M of CPWS Scheme at Ravulaparru and 12 other Habitations in Unguturu Mandal, under M- Book No.224B/RWS/S/D/E/r 2017-18 for amount of Rs. 1,74,187/- and pass

O R D E R This Writ Petition is filed seeking the following relief:
“….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not releasing the admitted/finalized amount to the petitioner for the completed work i.e. O & M of CPWS Scheme at Ravulaparru and 12 other habitants in Unguturu Mandal, under M-Book No.224B/RWS/S/D/E/r2017- 18 for amount of Rs.1,74,187/- as illegal, arbitrary, and violative of Articles 14 and 21 of the Constitution of India and also oppose to all cannons of justice, and consequently direct the respondents to forthwith release the due amount to the petitioner pending towards the completed work i.e. O&M of CPWS Scheme at Ravulaparru and 12 other habitants in Unguturu Mandal, under M-Book No.224B/RWS/S/D/E/r 2017- 18 for an amount of Rs.1,74,187/- and pass such other order or further orders…”
2. Heard learned counsel for the Writ Petitioner, learned Assistant Government Pleader for Panchayat Raj and Rural Development and the learned Standing Counsel for Gram Panchayat. 3. The Writ Petitioner claims to be the Managing Partner of M/s. Akshitha Constructions, executing various civil works awarded by the Government; that the Writ Petitioner participated in the tenders and got awarded O & M of CPWS Scheme at Ravulaparru and 12 other habitations in Unguturu Mandal and

executed the entire work as per the Agreement within stipulated time and handed over to the Department.
(b) It is the grievance of the Writ Petitioner that notwithstanding the completion of the works and its measurement by the competent authorities, an amount of Rs.1,74,187/- due towards the executed works has not been paid till date. According to the Writ Petitioner, although the works were completed long back, the respondent authorities have not released the admitted amount payable to him. Aggrieved by the non-payment of the said amount, the petitioner filed the present Writ Petition. 4. Learned Assistant Government Pleader for Panchayat Raj and Rural Development, on oral instructions, submits that there is no dispute with regard to the execution of the works. Learned Assistant Government Pleader submits that the Writ Petitioner is entitled to an amount of Rs.1,74,187/- and that proposals for release of grant were submitted to the District Collector, concerned, for release of the said amount and the same is in process, and seeks some time for payment of the said sum. 5. Having regard to the fact that there is no dispute with regard to the works executed by the Writ Petitioner and the amount

payable to it, and in view of the submissions of the learned Assistant Government Pleader for Panchayat Raj and Rural Development, the respondent authorities are directed to pay a sum of Rs.1,74,187/- (Rupees One Lakh Seventy Four Thousand One Hundred and Eighty Seven only) to the Writ Petitioner within a period of Four (4) weeks from the date of receipt of a copy of this order. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs of the Writ Petition.
