1. This court finds no good ground to grant indulgence in the matter with respect to the plea of the petitioner, who is an accused in a criminal complaint under section 138 of the Negotiable Instruments Act 1881, for transfer of the case from the file of Chief Judicial Magistrate, Shopian to another Magistrate of competent jurisdiction.
2. The transfer petition is dismissed.
3. The petitioner is directed to appear in person in the case on next date of hearing in person along with his counsel, failing which the court of Chief Judicial Magistrate Shopian shall be well within its discretion not only to forfeit the personal as well as surety bond of the petitioner and his surety but also to secure his presence by issuance of non-bailable warrants.
4. Learned counsel for the petitioner apprises this court that the next date fixed in the case before the court below is
13.03.2026 whereas non-bailable warrant issued against him are chasing the petitioner.
5. The non-bailable warrant so issued against the petitioner be not executed but in case the petitioner defaults in causing his personal appearance before Chief Judicial Magistrate Shopian on the date above-mentioned or any other date fixed in the case, the Chief Judicial Magistrate Shopian Shall be well within his right to issue fresh non-bailable warrant against the petitioner.
