Respondents For Petitioner : Ms. Kusum Lalchandani, Advocate For Respondent No.1 : Mr. Gajendra Prakash Sahu, Advocate appears on behalf of Mr. Abhishek Thakur, Advocate (Hon’ble Shri Justice Bibhu Datta Guru) Order on Board 02/09/2026 1. The present contempt petition has been filed alleging non-compliance of the order dated 24.03.2025 passed by this Court in WPS No.2594/2024, ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2026.09.05 16:50:12 +0530 2 whereby the writ petition filed by the petitioner was allowed and the order of termination impugned therein was quashed. Liberty was also reserved to the respondent authorities to take appropriate action against the petitioner in accordance with law, after following due process of law, including affording an opportunity of hearing to the petitioner. 2. Learned counsel for the petitioner submits that despite the aforesaid order, the respondents did not comply with the same and subsequently issued a show-cause notice dated 09.04.2025. It is contended that such action amounts to disobedience of the order passed by this Court. 3. Learned counsel appearing for the respondents, on the other hand, has placed on record the affidavit filed on behalf of respondent No.1 along with the relevant documents and would submit that the order passed by this Court has been complied with. 4. I have heard learned counsel for the parties and perused the documents. 5. From the material placed on record, it appears that pursuant to the order dated 24.03.2025, the petitioner submitted his representation before the competent authority. Thereafter, a show-cause notice dated 09.04.2025 was issued to the petitioner and an opportunity was afforded to him to submit his response. The subsequent action taken by the respondents is also reflected from the documents annexed with the affidavit. 6. Thus, from the affidavit filed by the respondents and the documents placed on record, it appears that the order dated 24.03.2025 passed by this Court has been complied with. The respondents have acted pursuant to the liberty granted by this Court and have followed the procedure 3 contemplated in the said order. In the circumstances, this Court is of the view that the material on record does not establish any wilful or deliberate disobedience of the order passed by this Court so as to warrant continuation of the contempt proceedings. 7. Accordingly, the contempt petition is dismissed and the Rule is discharged. SD/- SD/- (Bibhu Datta Guru) JUDGE ashu
