Mansaria, … for the defacto complainant. 1. Leave is granted to learned Advocate on record for the petitioner to implead the defacto complainant as a party respondent in this application. Let necessary corrections be made in course of the day. 2. The allegation is of attempted rape. The petitioner says that a false complaint has been lodged against him. He prays for pre-arrest bail. 3. The State opposes the prayer. Learned State Advocate fairly points out that the victim lady, a married person, refused medical examination. 4. Further, learned Advocate for the defacto complainant/victim says that she has instructions not to oppose this application for anticipatory bail. 2
5. Hence, I allow this application for anticipatory bail. 6. Accordingly, in the event of arrest, the petitioner, namely Dipankar Barman, shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that the petitioner shall report to the Inspector in charge of the concerned police station once in a fortnight and also as and when called for until further orders. The petitioner shall go and meet the Inspector in Charge of the concerned police station within three days from date. 7. In case the petitioner fails to adhere to any of the conditions mentioned hereinabove or in Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 8.
The application for anticipatory bail being CRM (A) 665 of 2026 is disposed of. 9. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. ( Arijit Banerjee, J. )
