1. The present writ petition is directed against the inaction of the respondent authorities particularly Respondent no. 3, in not deciding the petitioner's representation seeking compensation in respect of private land which has admittedly been utilized and merged into a public road without acquisition AVINASH SHARMA Digitally signed by AVINASH SHARMA Date: 2026.09.04 16:16:12 +0530
2 proceedings and without payment of any compensation.

Learned counsel for the petitioner submits that petitioner is the Bhumiswami/recorded owner of land bearing Khasra No. 321/15 admeasuring 0.068 hectare situated at Village Amlibhauna, Tahsil and District Raigarh. Upon seeking demarcation of the said land before the revenue authorities, it came to light from the official demarcation proceedings and report of the Revenue Inspector that the petitioner's land has already been absorbed/merged into the road connecting Transport Nagar to Mitthumuda. Despite the above categorical findings recorded by the revenue authorities, the petitioner has neither been paid compensation nor has any acquisition proceeding been undertaken in accordance with law with respect to the above land which led the petitioner to submit a detailed representation dated 10.04.2026 & 11.04.2026 (Annexure P/3), before the competent authorities seeking either payment of compensation in accordance with prevailing market value or, in the alternative, exchange of equivalent Government land. However, the aforesaid representations are pending
consideration, therefore, it is prayed that respondent authorities may be
directed to decide the said representation (Annexure P/3) within some stipulated time frame in accordance with law.
3. Learned State counsel submits that representation of the petitioner will be decided within 45 days in accordance with law.

In view of the aforesaid submission, without entering into the merits of the claim of the petitioner, the present writ petition is disposed of with a direction to the competent respondent authority to consider and decide the petitioner's representation dated 10.04.2026 and 11.04.2026 (Annexure P/3) within a
3 period of 45 days from the date of receipt of a copy of this order.
5. If considered necessary, an opportunity of hearing shall also be afforded to the petitioner and other relevant stakeholders before passing an appropriate reasoned and speaking order.
6. It is made clear that this Court has not expressed any opinion on the merits of the petitioner's claim, and the competent authority shall take an independent decision in accordance with law. Sd/-
