ORAL ORDER
1. Accused no.1 is before the Court in Crime No.101 of 2026 registered by Masti Police Station, Kolar District for offences punishable under Sections 115(2), 118(1), 189(2), 118(2), 190, 191(2), 191(3) & 352 of BNS, 2023 is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No.101 of 2026 was registered by Masti Police Station, Kolar District for the aforesaid offences against the petitioner and others, based on the first information dated 23.06.2026 received from Sri Samappa, who is the injured victim in the present case. Apprehending arrest, petitioner had filed Crl.Misc.No.599 of 2026 before the jurisdictional Sessions Court, which was dismissed as against him on 13.07.2026. Therefore, he is before this Court.
4. Perusal of the material on record would go to show that, accused and victims had fought against each other on

22.06.2026 at about 05.30 p.m. In respect of the said incident that had taken place on 22.06.2026, there is a case and counter case registered by the very same police in Crime No.102 of 2026 and petitioner is arrayed as accused no.1 in Crime No.101 of 2026. FIR in Crime No.102 of 2026 is registered against Sri Samappa and seven others, based on the first information received from the petitioner herein, for offences punishable under Section 115(2), 118(1), 191(2), 191(3), 190, 189(2), & 352 of BNS, 2023.

Perusal of the first information in Crime No.102 of 2026 would go to show that, petitioner was admitted in a government hospital and based on the statement recorded by the police while he was admitted in hospital, FIR has been registered in Crime No.102 of 2026 against Sri samappa and others. Petitioner in Crime No. 102 of 2026, Samappa and other accused have been granted anticipatory bail by the jurisdictional Sessions Court in Crl.Misc.No.658 of 2026 by
order dated 20.07.2026.

6. Considering the aforesaid aspects of the matter and also the nature of injury sustained by both parties, I am of the opinion that, the petitioner is entitled for the relief sought for in this petition.
7. Accordingly, the following:
ORDER (i) The Criminal Petition is allowed. (ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.101 of 2026 registered by Masti Police Station, Kolar District for offences punishable under Sections 115(2), 118(1), 189(2), 118(2), 191(2), 190, 191(3) & 352 of BNS, 2023, subject to the following conditions:
1. The petitioner shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the

satisfaction of the investigating officer/jurisdictional Court.
2. The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.
3. The petitioner shall not tamper with the prosecution witness and he shall co-operate with the Police for investigation and appear before them whenever called upon.
4. The petitioner shall not involve in similar offences in future.
