For Petitioner : Mr.P.Krishnasamy For Respondents : Mr.I.Pinaygash Counsel for the State (For R1 to R3) Mr.Mohamed Riyaz Government Advocate (Crl Side) (R4) O R D E R This petition has been filed seeking to direct the respondents 2 to 3 to survey the Petitioner's property and fix boundary stones in respect of Natham New Survey No.108/14 (Old Survey No.18) to an extent of 0.00.30.0 square meters situated at Karuppayurani Village, Kalikappan II Bit Village, Madurai 2/7 https://www.mhc.tn.gov.in/judis W.P.(MD)No.15943 of 2026 East Taluk, Madurai District, under the supervision of the 4th Respondent for surveying the land, based on the Petitioner's representation dated 06.05.2026 within a time frame to be stipulated by this Court. 2. The learned counsel for the petitioner submitted that the petitioner is claiming rights over the property situated in New Survey No.108/14 (Old Survey No.18), measuring an extent of 0.00.30.0 square meters, which originally belonged to her father, Sivaji Pandi, in whose name the patta also stands. It was further submitted that the petitioner’s mother had been regularly paying electricity charges and property taxes to the concerned authorities. The learned counsel further submitted that the petitioner’s father passed away about 20 years ago, leaving behind the petitioner, her mother, and two sisters as his legal heirs. Subsequently, the petitioner’s mother died on 30.05.2019, after which the petitioner and her two sisters became entitled to rights over the said property. The petitioner is also stated to have a son. It was further submitted that when the petitioner and her son visited the property, respondents 5 and 6 allegedly threatened and abused them. In these circumstances, the petitioner lodged a complaint before the Karuppayurani Police Station. However, it is alleged that 3/7 https://www.mhc.tn.gov.in/judis W.P.(MD)No.15943 of 2026 respondents 4 and 5 have unlawfully grabbed the property without allotting the petitioner her rightful share. Hence, the petitioner seeks appropriate directions for surveying and demarcating the property. 3. Heard the learned Counsel appearing for the State/respondents 1 to 3 and the learned Government Advocate (Criminal Side) appearing for the 4th respondent. 4. Considering the facts and circumstances of the case, this Court directs the 2nd respondent to conduct the survey and demarcate the property with the assistance of the 3rd respondent after issuing notice to the petitioner and her two sisters as well as the respondents 5 and 6. If necessary, seek police protection, the 4th respondent shall provide police protection to survey the land. In case the petitioner seeks to install the boundary stone, the same may be provided at the cost of the petitioner. In case, the respondents 4 and 5 are in possession of the property, the petitioner shall follow due process of law to evict the encroachment. The Court is also directing the Official respondents to adhere to the following 4/7 https://www.mhc.tn.gov.in/judis W.P.(MD)No.15943 of 2026 Standard Operating Procedures: a. The Official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. b. After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest.
