2. Mr. Mukesh Singh Rawat, learned counsel for the Respondents.
3. Heard on the Delay Condonation Application.
4. This Court finds that the delay has been satisfactorily explained. Accordingly, the delay is condoned and the Delay Condonation Application stands allowed.
5. The present Special Leave to Appeal has been filed on behalf of the State under Section 419(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking leave to prefer a Government Appeal against the judgment and order dated 10.07.2025, passed by the learned Special Sessions Judge, District Chamoli (Gopeshwar), in Special Sessions Trial No. 11 of 2020, “State vs. Anuj Dimri and Another”, under Sections 8/21 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
6. Considering the submissions advanced by learned counsel for the parties, this Court is of the view that, at this stage, sufficient grounds exist to grant leave. Accordingly, the Special Leave to Appeal is granted.
7. Summon the Trial Court Record (TCR).
8. Upon receipt of the TCR, the Registry is directed to prepare the paper book and supply copies thereof to learned counsel for the parties, in accordance with Rules.
9. Objections, if any, be filed by the Respondents.
10. List this case on 13.05.2026 for hearing.
