JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.1 in Crime No.64/2026 registered by Jigani Police Station, Bengaluru for the offences punishable under Sections 86, 80(2), 3(5) Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS') read with Sections 3 and 4 of the Dowry Prohibition Act, 1961, is before this Court in this petition filed under Section 483 of Bharatiya Nagarak Suraksha Sanhita, 2023, seeking regular bail. 2. Heard learned counsel appearing for the parties. 3. FIR in Crime No.64/2026 was registered by the Jigani Police Station, Bengaluru for the offence punishable under Section 80 of BNS, 2023 against the petitioner herein and his mother based on the first information dated 21.03.2026, - 3 - HC-KAR CNR: KAHC010408022026 NC: 2026:KHC:42008 CRL.P No. 8668 of 2026 received from Sharanappa, father of the deceased, Bouramma, who was the wife of the petitioner. In the said case, the petitioner was arrested on 23.03.2006 and remanded to judicial custody. After completing investigation, charge-sheet has been filed against two persons for the aforesaid offences and the petitioner is arrayed as accused No.1 in the charge-sheet. His bail application filed before the jurisdictional Sessions Court in Crl.Mis.No.5165/2026 was rejected on 15.04.2026. Therefore, he is before this Court. 4. The material on record would go to show that the petitioner is the husband of the deceased Bouramma and their marriage was solemnized on 05.11.2022. In the first information, it is alleged that, at the time of marriage, the accused persons were given dowry in cash and gold as per their demand. It is also alleged that in the matrimonial house, Bouramma was ill-treated and tortured by accused persons in furtherance of their demand for additional dowry. The first informant had received information on the early hours of 21.03.2026 that his daughter had died. Suspecting foul play in the death of his daughter, the first informant had approached - 4 - HC-KAR CNR: KAHC010408022026 NC: 2026:KHC:42008 CRL.P No. 8668 of 2026 the police and it is under these circumstances, FIR was registered against the petitioner and his mother. 5. After completing the investigation, charge-sheet is now filed against accused No.1 and 2 for the aforesaid offences. Perusal of the charge-sheet material would go to show that Bouramma was facing certain health conditions and therefore she was being treated for the same. It appears that ever since the year 2024, Bouramma was being treated in various hospitals and on 20.03.2026, the petitioner had taken his wife Bouramna on his motorcycle to a medical clinic in Jigani and while returning from the said clinic at about 08.30 p.m., Bouramma, who was riding pillion in the motorbike of the petitioner, accidentally fell down from the motorbike, collapsed and suffered injuries. Immediately thereafter she was shifted to Vijayasri Hospital at Jigani, but she was declared brought dead. Perusal of the charge-sheet would go to show that the death of the deceased was accidental and it was the petitioner who had shifted the deceased to a hospital immediately after she fell down from his motorbike. Considering the nature of allegations found as against the petitioner, who has no other criminal - 5 - HC-KAR CNR: KAHC010408022026 NC: 2026:KHC:42008 CRL.P No. 8668 of 2026 antecedents, his prayer for grant of regular bail needs to be answered in the affirmative. Hence, the following: ORDER (i) The criminal petition is allowed. (ii) The petitioner/accused No.1 is ordered to be enlarged on bail in Crime No.64/2026 registered by Jigani Police Station, Bengaluru for the offences punishable under Sections 86, 80(2), 3(5) Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS') read with Sections 3 and 4 of the Dowry Prohibition Act, 1961, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 6 - HC-KAR CNR: KAHC010408022026 NC: 2026:KHC:42008 CRL.P No. 8668 of 2026 d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed of.
