Accused in Crime No.50 of 2026 registered by Y N Hosakote Police Station, Tumakuru District for offences punishable under Sections 109 and 118(1) of BNS, 2023 is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.50 of 2026 was registered by Y N Hosakote Police Station, Tumakuru District, for the aforesaid offences against the petitioner herein, based on the first information dated 25.05.2026 received from injured victim Sri Nagendra. Apprehending arrest in the case, petitioner had filed Criminal Misc.No.5207 of 2026 before the jurisdictional Sessions Court, which was rejected on 15.06.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that, in respect of the alleged incident that had taken place on 25.05.2026, there is a case and counter case registered by Y N - 3 - HC-KAR CNR: KAHC010424372026 NC: 2026:KHC:40507 CRL.P No. 8969 of 2026 Hosakote Police Station in Crime No.50 of 2026 and Crime No.51 of 2026. Alleged victim in the present case is accused no.1 in Crime No.51 of 2026 and the petitioner and his family members are the injured victims in the said case. 5. Learned HCGP on instruction submits that, victim in the present case has suffered only simple injury. 6. Considering the aforesaid aspects of the matter, the following :- ORDER (i) The Criminal Petition is allowed. (ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.50 of 2026 registered by Y N Hosakote Police Station, Tumakuru District for offences punishable under Sections 109 and 118(1) of BNS, 2023, subject to the following conditions: 1. The petitioner shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal - 4 - HC-KAR CNR: KAHC010424372026 NC: 2026:KHC:40507 CRL.P No. 8969 of 2026 bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the investigating officer/jurisdictional Court. 2. The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. The petitioner shall not tamper with the prosecution witness and he shall co-operate with the Police for investigation and appear before them whenever called upon. 4.
