Heard Mr. A. K. Ahmed, learned counsel for the petitioners. Also heard Mr. B. Sarma, learned Additional Public Prosecutor for the State. 2. This petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioners, namely, (1) Ajmot Ali (2) Billal Ali and (3) Saddam Ali, have prayed for granting pre-arrest bail, apprehending arrest in connection with Hajo P.S. Case No. 429/2025, registered under Section 61(2) /329(3) /189(2)/189(4) /103(2)/118(2)/109/3(5) of BNS, 2023. 3. Case diaries as called for is received. 4. The brief fact of the case is that on 11.10.2025 informant Fakhrul Ali lodged a FIR before O/C, Hajo PS alleging interalia that on 10.10.2025 at about 12.00 PM the FIR named accused persons had launched a pre- planned attack upon the informant and his family members while they were worked on their ancestral land. The accused persons attacked the
Page No.# 3/3 Complainant and his family members with Dao, Knives, Otrods, axes, sticks etc. in their hands. During the attack the accused persons had stabbed the informant's brother namely Rashmil Ali in his head and severed his left arm with dao, resulting in his death on the spot. For the attack of the accused persons Hasen Ali, Ahmed Ali and the informant sustained serious injuries on their persons. The injured were taken to GMCH for their better treatment and they were fighting with death in the hospital. 5.
As per post-mortem report, the deceased died due to coma as a result of injury sustained in the head and all injuries are ante mortem caused by sharp weapon and are homicidal in nature. 6. The contents of the case diary including the statements of the witnesses have clearly implicated the present petitioner. As far as the case diary of the cross FIR lodged by the petitioner side is concerned, there appears to be no material against the accused persons therein i.e. the informant side of the present case. 7. Having regard to the above, as well as the grave nature of the offence, the prayer for pre-arrest bail stands rejected. 8. Accordingly, this anticipatory bail application stands disposed of. 9.
