In the High Court At Calcutta Jalpaiguri Circuit Bench
CRM (A) 608 of 2026
In re: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure/Section 482 of the BNSS in connection with Bhorer Alo Police Station Case No. 222 of 2026 dated 04.07.2026 under Sections 126(2)/117(2)/118(2)/109(1)/3(5) of the BNS, 2023. - A n d -
In the matter of : Samijuddin Ahmed & Ors. .... Petitioners. Mr. Sudip Guha, Ms. S. Das, Ms. A. Nag, … For the Petitioners. Mr. Avrajyoti Das, Mr. G. Ghosh, Mr. R. Das, … for the State.
1. The petitioners say that the FIR was lodged after delay of nine months. The incident is of October, 2025. The FIR was lodged in July, 2026. The incident was an outcome of political rivalry. They pray for anticipatory bail.
2. Learned State Advocate opposes the prayer. He tells me that the victim succumbed to the injury that was inflicted on him by the petitioner and other accused persons and passed away on August 7, 2026. Charge under Section 103 of the BNS, 2023 has been added.
3. In view of the gravity of the charge leveled against the petitioners and considering their possible complicity in the alleged crime, I am not inclined to allow this application for pre- arrest bail.
