JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused Nos.2 and 3 in Crime No.163/2026 registered by Cottonpet Police Station, Bengaluru City for the offences punishable under Section 109(1), 115(2) read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. - 3 - HC-KAR CNR: KAHC010423802026 NC: 2026:KHC:39808 CRL.P No. 9037 of 2026 2. Heard the learned counsel for the parties. 3. FIR in crime No.163/2026 was registered by Cottonpet Police Station, Bengaluru City against one Prathap and the petitioners herein, based on the first information dated 01.06.2026 received from Pradeep M., who is one of the injured victim in the present case. During the course of investigation, the petitioners herein were arrested on 01.06.2026 and remanded to judicial custody. Their bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5515/2026 was dismissed on 16.06.2026. Therefore, they are before this Court. 4. Perusal of the material on record would go to show that first informant and accused No.2 are friends. On 31.05.2026 at about 11.45 p.m., when the first informant and his friend Pushpendra were talking to each other, the first informant had friendly patted on the back of Pushpendra and this was objected by accused No.2, who assaulted the first informant on his face. Subsequently, - 4 - HC-KAR CNR: KAHC010423802026 NC: 2026:KHC:39808 CRL.P No. 9037 of 2026 Pushpendra went to his house and when the first informant questioned accused No.2 as to why he had assaulted him, accused Nos.2 and 3 allegedly assaulted the first informant with their hands. The brother of the first informant came there to rescue the first informant and at that time, accused No.1 allegedly assaulted the first informant and his brother Prasad with a weapon and caused injuries. 5. Allegation of assaulting the first informant and his brother with a weapon and causing injuries as found in the first information is only against accused No.1, Prathap. So far as the petitioners are concerned, they allegedly had assaulted the injured with their hands. They are in custody from 01.06.2026 onwards and undisputedly they do not have criminal antecedents. 6. Under the circumstances, I am of the opinion that the prayer made by the petitioners for grant of - 5 - HC-KAR CNR: KAHC010423802026 NC: 2026:KHC:39808 CRL.P No. 9037 of 2026 regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following: O R D E R The Criminal Petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.163/2026 registered by Cottonpet Police Station, Bengaluru City for the offences punishable under Section 109(1), 115(2) read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, subject to the following conditions: a) The petitioners shall execute personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; - 6 - HC-KAR CNR: KAHC010423802026 NC: 2026:KHC:39808 CRL.P No. 9037 of 2026 c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
