This is the third bail application filed under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.07/2026, registered at Police Station Lalpur, District Mungeli (C.G.) for the offence punishable under Sections 109 (1), 296 read with Section 3 (5) of BNS. 2. The first bail application of the applicant was dismissed on merits vide order dated 29.04.2026 in MCRC No.3902/2026 and thereafter the second bail application was also dismissed on merits vide order dated 02.07.2026 in MCRC No.5848/2026.
3. The case of the prosecution, in brief, is that on 15.01.2026, the complainant, namely Rakesh Kurre, lodged a written complaint at Police Station Lalpur, District Mungeli (C.G.). He stated that his brother, Suaraj Kurre, along with his friends, had gone to the premises of the High School at Village Barampur to participate in a program organized on the occasion of Guru Ghasidas Jayanti. During the course of the event, they went to a nearby pan shop, where a dispute was ongoing between the shopkeeper and the present applicant. When the complainant's brother attempted to intervene in the matter, the applicant, along with other co- accused persons (who are juveniles), allegedly assaulted him with a knife, causing serious injuries. Based on the said written complaint, an registered. The injured person was medically examined, and the applicant was subsequently arrested by the concerned prosecution authorities. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in crime in question. He further submitted that the co-accused who are juvenile has already been granted bail by the learned Trial Court and the applicant is in jail since 15.01.2026 i.e. for more than 7 months.
3 He further submitted that 7 prosecution witnesses out of 19 have been examined till date and only PW-1 injured Suraj Kumar Kurre and PW-2 brother of injured Rakesh Kurre only have supported the prosecution case whereas the other prosecution witnesses have not supported the prosecution case, therefore, he prays that the applicant be released on regular bail.

On the other hand, learned State counsel opposes the bail application of the applicant and submits that the previous bail applications of the applicant were dismissed on merits and the injured and his brother have supported the prosecution case in their examination, therefore, the applicant is not entitled to be released on bail.
6. I have heard learned counsel for the parties and perused all the documents available on record.

Considering the facts and circumstances of the case, nature and gravity of the allegations and the fact that the first bail application of the applicant was dismissed on merits by this Court vide order dated 29.04.2026 passed in MCRC No.3902/2026 and thereafter the second bail application of the applicant was also dismissed on merits vide order dated 02.07.2026 in MCRC No.5848/2026 and further taking into consideration the specific allegation against the applicant that he caused injuries to the injured/victim by using a knife and the victim and his brother have supported the prosecution case, as is evident from their deposition sheet
4 annexed with the bail application, therefore, I am not inclined to entertain this repeat bail application.

Accordingly, the instant bail application of the applicant Rupesh Kumar Patre, involved in Crime No.07/2026, registered at Police Station Lalpur, District Mungeli (C.G.) for the offence punishable under Sections 109 (1), 296 read with Section 3 (5) of BNS, is rejected.
