NATARAJ ORAL ORDER The petitioner has challenged an order dated 27.06.2017 passed by the Principal Civil Judge and JMFC, Chikkanayakanahalli, in Crl.Misc.No.170/2013 as well as the order dated 10.01.2019 passed by the V Additional District and Sessions Judge, Tiptur, in Crl.R.P.No.10009/2018. 2. The respondent is the wife of the petitioner, who filed a petition under Section 125 of Code of Criminal Procedure, 1973 (henceforth referred to as 'Cr.P.C.') claiming maintenance. The trial Court after recording evidence, passed an order allowing the petition in part and directed payment of maintenance of Rs.15,000/- per month. This was unsuccessfully challenged by the petitioner in Crl.R.P.No.10009/2018. Therefore, the petitioner is before this Court challenging the said orders. - 3 - HC-KAR NC: 2026:KHC:19317 CRL.P No. 2457 of 2019 3. The learned counsel for the petitioner submits that the petitioner had purchased substantial property in the name of the respondent and that the respondent is not entitled for any maintenance. He also submits that the respondent has sufficient properties in her name and therefore, there is no need for any maintenance to be granted. He also submits that the salary drawn by the petitioner is not sufficient to pay maintenance of Rs.15,000/- per month ordered by the trial Court. 4. A perusal of the records shows that the petitioner was serving as an Assistant Executive Engineer in the Karnataka Rural Infrastructure Development Limited (KRIDL). He has a permanent residence at Mysore. It is his case that he was drawing a monthly salary of Rs.50,000/-. The savings bank account maintained by him at ING Vysya Bank, Mysore, showed that he was earning more than Rs.50,000/- per month. Therefore, the impugned order passed by the trial Court directing the petitioner to pay a sum of Rs.15,000/- per month as maintenance is not excessive, having regard to the cost of living. - 4 - HC-KAR NC: 2026:KHC:19317 CRL.P No. 2457 of 2019 5. In that view of the matter, no interference is warranted with the impugned orders passed by the trial Court and the Revisional Court. Hence, the petition is dismissed. Sd/- (R.
